  66. Commodore Program Licence Agreement and Limited Warranty

  68. Carefully read all the terms and conditions of this agreement to your use
  69. of the enclosed Media.  Your use of the enclosed media indicates your
  70. acceptance of these terms and conditions.

  72. 1.  COPYRIGHT.  THESE PROGRAMS AND THE RELATED DOCUMENTATION ARE
  73. COPYRIGHTED.  YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE PROGRAMS OR
  74. DOCUMENTATION OR ANY COPY THEREOF EXCEPT AS EXPRESSLY PROVIDED IN THIS

  77. 2.LICENSE.  You have the non-exclusive right to use any enclosed program
  78. only on a single computer.  You may load the program into your computers
  79. temporary memory (RAM).  You may physically transfer the program from one
  80. computer to another provided that the program is used on only one computer
  81. at a time.  You may modify or translate the program providing such
  82. modification or translation is for your own use and that no more than one
  83. such modified or translated copy exists at any one time.  You may not
  84. electronically transfer or access the program from another computer over a
  85. network.  You may not distribute copies of the program or accompanying
  86. documentation to others.  You may not decompile disassemble or reverse
  87. engineer the program.  You may not attempt to unlock or bypass any copy
  88. protection utilized with the program.  Title to the program and all other
  89. rights and uses not specifically granted in this license are reserved by
  90. Commodore.

  92. 3.  BACK-UP AND TRANSFER.  You may make one (1) copy of the program solely
  93. for back-up purposes.  You must reproduce and include the copyright notice
  94. on the back-up copy.  You may transfer and license the product to another
  95. party only if the other party agrees to the terms and conditions of this
  96. Agreement and completes and returns a registration card to Commodore.  If
  97. you transfer the program you must at the same time transfer the
  98. documentation and back-up copy or transfer the documentation and destroy
  99. the back-up copy.

  101. 4.TERMS.  This license is effective until terminated.  You may terminate it
  102. by destroying the program and documentation and all copies thereof.  This
  103. licence will also terminate if you fail to comply with any term or
  104. condition of this Agreement.  You agree upon such termination to destroy
  105. all copies of the program and documentation.

  107. 5.  PROGRAM DISCLAIMERS.  The programs are provided 'AS IS' without
  108. warranty of any kind, either expressed or implied including, but not
  109. limited to, the implied warranties of merchantability and fitness for a
  110. particular purpose.  The entire risk as to the results and performance of
  111. any program is assumed by you.  Should the program prove defective, you
  112. (and not Commodore or its dealers) assume the entire cost of all necessary
  113. servicing, repair or correction.  Further, Commodore does not warrant,
  114. guarantee or make any representations regarding the use of or the results
  115. of the use of,the program in terms of suitability.  accuracy, reliability,
  116. currentness or otherwise; and you may rely on the program and results
  117. solely at your own risk.

  119. 6.MEDIA LIMITED WARRANTY.  Commodore warrants to the original licensee that
  120. the media on which the program is recorded shall be free from defects in
  121. material and workmanship only for a period of ninety (90) days from the
  122. date of original purchase.  If a defect covered by this warranty occurs
  123. during this 90-day warranty period and is returned to the dealer from whom
  124. it was purchased not later than five (5) days at the end of the such 90-day
  125. period, the dealer shall, at the dealers option, either repair or replace
  126. this product.The above warranty is exclusive and in lieu of all other
  127. conditions and warranties, express or implied,including, but not limited to
  128. implied conditions or warranties of merchantability or fitness for a
  129. particular purpose and those arising by statute or otherwise in law,
  130. prohibit the exclusion of such implied warranties they shall be limited to
  131. a period of 90 days from the date of your original purchase.  No conditions
  132. or warranties, either express or implied, will apply after this period.

  134. 7.  LIMITATION OF LIABILITY:  Commodore's liability is limited solely to
  135. the repair or replacement of the defective product, in its sole discretion,
  136. and shall not in any event include damages for loss of use or loss of
  137. anticipated profits or benefits or other incidental or consequential costs,
  138. expenses or damages, including without limitation any data or information
  139. which may be a lost or rendered inaccurate, even if Commodore has been
  140. advised of the possibility of such damages.  Some states do not allow an
  141. exclusion of implied warranty or limitation of incidental or consequential
  142. damages, so the above limitations or exclusions may not apply to you.  This
  143. warranty gives you specific legal rights and you may also have other rights
  144. which vary from state to state.

  146. 8.  MISCELLANEOUS:  This agreement represents the entire understanding
  147. regarding the programs and related documentation and supersedes any prior
  148. purchase order, communications or representations.  This agreement may only
  149. be modified by a written amendment signed by an officer of Commodore.  If
  150. any provision of the agreement shall be deemed unlawful, void, or for any
  151. reason, unenforceable it shall be deemed severable from and shall in no way
  152. effect the validity and enforceability of the remaining provisions of the
  153. agreement.  This license agreement shall be governed by the laws of the
  154. United States of America, Commonwealth of Pennsylvania.  This product
  155. cannot be exported without the appropriate government license.

  157. If this product is being acquired for or on behalf of the United States of
  158. America, its agencies and/or instrumentalities, it is provided with
  159. RESTRICTED RIGHTS, and all use, duplication or disclosure with respect to
  160. the included software and documentation is subject to the restrictions set
  161. forth in The Rights in Technical Data and Computer Software clause at
  162. 252.227-7013 of the DOD FAR and the Rights in Data-General clause at
  163. 52.227-14 of the FAR.

  170. its parent, and all affiliated companies thereof.
